TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEPERGUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for Premium subscription in the 12 months preceding the claim.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected.
You agree to indemnify, defend, and hold harmless DeeperGuard and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App or violation of these Terms.
We may terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the App will cease immediately.
You may terminate your account at any time by canceling your subscription (if applicable) and discontinuing use of the App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DeeperGuard operates, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization, except where prohibited by law.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
